- Compensation for student from Poland - Peter
After treatment in England, he returned home for further treatment.
He instructed our English lawyers to make a claim and signed a Conditional Fee Agreement. Because of the seriousness of his injuries it was necessary for him to return to England 3 times for meetings with medical experts and his legal team.
The insurance company for the employer tried to blame Piotr at first, but our lawyers refused to give up and a settlement of the claim was agreed. Piotr received 180.000,00 pounds to compensate him for the loss of his fingers and his other injuries as well as loss of earnings and medical expenses. He received his compensation in full - the insurance company paid all his legal bills on top.
- Claims for Mr Smith
Mr Smith was employed as an Engineer servicing Fork Lift Trucks. He had gone to a Factory to service a number of Fork Lift Trucks. During the course of that service he needed some parts and made his way to a shed where those parts were kept. He collected the required parts but as he left the shed with the parts he caught his foot on something lying on the floor causing him to fall and trip forwards.
As a result he sustained ligament and soft-tissue injuries to his left shoulder. After the issue of Proceedings Mr Smith received 13.000,00 pounds to compensate him for his injuries and other losses. He received his compensation in full, the Insurance Company paying all of his legal bills on top.
- Compensation for accident at work of Miss Jayne Plater
Miss Jayne Plater worked as a dispatch/warehousing clerk. In the course of her work she had to unload a lorry and whilst doing so picked up a fairly large box, about 60cm high and 30cm wide. As she lifted the box something heavy inside it fell against the side of her wrist and she immediately felt pain in her arm and hand.
We found out that the box had contained a large blanking plate weighing 18kg, which had been left upright in the box with only minimal packing. We further discovered that there had been previous complaints by staff about the supplier of the box, relating to improperly and unsafely packed items.
The client suffered a hairline crack in a small bone in her wrist which, although it was substantially recovered in three months, initially required a plaster cast. The client received 3.000,00 pounds in compensation, with legal fees paid on top.
- Compensation for Mr Ugo Leandros
Mr Ugo Leandros worked for a small firm making kitchen equipment and part of his work involved loading unwanted chipboard kitchen units into a crusher and operating it. One day he found the door of the crusher would not open after use, so, copying what he had seen other workers do, he used a hammer to release the latch. The door of the crusher flew open - it had been jammed by the press of crushed wood behind it - and hit him in the face, causing a cut, a neck injury and subsequent headaches.
The insurers of Mr Leandros' employers said the accident was partially his fault as he had not followed the correct procedure for opening the door when jammed. Mr Leandros (who spoke very little English) told us through an interpreter that nobody had told him of any other procedure.
Substantially, Mr Leandros won on this point and he received 5.000,00 pounds in compensation, together with his legal costs.
